API Terms of Service

1. Acceptance of Terms

By accessing or using the API service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

Subject to compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the API solely for your individual, non-commercial use.

2.1 Commercial Use

The Service is intended strictly for individual, non-commercial use. For commercial use, such as incorporating the data into a paid/commercial product, a new commercial billing tier will be available in the near future. 3. Subscription and Payment

• Access to the Service is provided on a subscription basis.
• Fees are billed monthly in advance unless otherwise agreed.
• Failure to pay fees when due will result in suspension or termination of access to the API.
• We reserve the right to modify pricing with reasonable notice.

4. API Access and Authentication

• Access to the API requires a valid API key or other authentication credentials.
• API keys are confidential and must not be shared, distributed, or exposed to third parties.
• You are solely responsible for all activity conducted using your API credentials.
• You must immediately notify us if you suspect unauthorized use of your API key.

5. Acceptable Use

You agree not to: - Use the API in any unlawful manner. - Reverse engineer, decompile, or attempt to extract source code from the Service. - Circumvent or exceed rate limits or usage quotas. - Resell, sublicense, or provide access to the API to third parties without explicit permission. - Use the API in a way that could harm the Service or its users.

6. Rate Limiting and Fair Use

We may impose rate limits, usage caps, or other controls to ensure fair usage. Exceeding these limits may result in throttling, suspension, or additional charges.

7. Suspension and Termination

We may suspend or terminate your access to the Service: - If payment is overdue - If you violate these Terms - If your use poses a security or operational risk

Upon termination, your license to use the API is revoked immediately.

8. Service Availability

• The Service is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free operation.
• We may modify, suspend, or discontinue the Service at any time.

9. Data and Privacy

• We collect and retain only the minimum personal data necessary to operate the Service, specifically the user’s email address for account management and payment processing.
• We do not store or retain any other personal data submitted through the API.
• You retain ownership of any data you submit to the API. We process such data transiently and solely as required to provide the Service.
• You are responsible for ensuring that your use of the API complies with applicable data protection laws.

9.1 Data Processing Agreement (DPA)

To the extent that we process personal data on your behalf: - We act as a data processor and you act as the data controller. - We process personal data only in accordance with your instructions as necessary to provide the Service. - We implement appropriate technical and organisational measures to protect personal data. - We do not sell, share, or use personal data for purposes other than providing the Service.

9.2 Data Retention and Deletion

• We retain user email addresses only for as long as necessary to manage subscriptions and payments.
• If you wish to have your data removed from our systems, you may request deletion by contacting us at the email provided below.
• Upon verified request, we will delete your personal data within a reasonable timeframe, subject to any legal or regulatory obligations.

10. Intellectual Property

All rights, title, and interest in and to the Service, including all underlying technology, remain our exclusive property. No rights are granted except as explicitly stated in these Terms.

11. Limitation of Liability

To the maximum extent permitted by law: - We shall not be liable for any indirect, incidental, or consequential damages. - Our total liability shall not exceed the amount paid by you in the preceding 12 months.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction.
